A short drive, a steel wire in the dark, and a moment that could not be undone.
A Night Out in Georgia
In late August 2004, Frankie Brohm, 23, spent the evening drinking with his longtime friend, John Kemper Hutcherson, in Cobb County, Georgia. After leaving a bar, the two got into Hutcherson’s pickup truck to drive home.
There was no reported argument. No confrontation. By all accounts, it was a routine ride after a night out.

The Passenger Seat
During the drive, Frankie began to feel sick. According to court testimony, he leaned his head out of the passenger-side window because he thought he was going to vomit.
As the truck continued down the road, it drifted off course. Along the roadside was a steel guide wire attached to a utility pole. The wire was positioned low and would have been difficult to see in the dark.
Frankie’s head struck the wire.
The impact decapitated him instantly.
There was no high-speed collision. No major damage to the vehicle. The fatal injury occurred in a matter of seconds.
The Drive Home
Authorities later stated that Hutcherson, who had been drinking, continued driving approximately 10 to 12 miles back to his home in the Atlanta suburbs.
He parked in his driveway and went inside. Frankie’s body remained in the passenger seat overnight.
Police reports indicated that Hutcherson did not immediately grasp what had occurred.
The Next Morning
The following morning, a neighbor noticed something wrong and called 911.
When officers responded, they discovered Frankie’s body in the truck parked in the driveway. His head was later located near the roadside utility pole where the impact occurred.
What had begun as a late night out ended as a DUI vehicular homicide investigation.
The Investigation
Hutcherson was found to have been driving under the influence. He was charged with vehicular homicide, DUI, and failure to maintain lane.
There was no evidence of intent to harm. The case was prosecuted as a fatal accident resulting from impaired driving.
The Sentencing Hearing
In May 2005, Hutcherson pleaded guilty to vehicular homicide.
He was sentenced to five years in prison.
During the sentencing hearing, Frankie Brohm’s parents addressed the court. Public reports at the time noted that they expressed forgiveness toward Hutcherson. While they acknowledged the irreversible loss of their son, they stated they did not want their lives defined by anger.
The court proceedings closed the criminal case, but they did not erase the circumstances that led to it.
